Corporate Solvency & Financial Condition

J.B. is currently serving as an expert witness retained by plaintiffs who are former United States military service members who suffered injuries from their use of 3M Company Combat Arms Version 2 earplugs. J.B.'s analysis is focused on 3M Company's likely minimum liability for contingent claims at issue in a multi-district litigation pending in the United States District Court for the Northern District of Florida, the largest MDL in U.S. history. This matter follows J.B.'s declaration, deposition, and testimony related to an unsuccessful attempt by 3M Company's subsidiaries in bankruptcy, In Re: Aearo Technologies LLC, et al. 22-02890-JJG-11 (Bankr. S.D. Ind.), to extend protections against further litigation to 3M Company itself. 

In late 2021, J.B. served as a solvency expert in Intelsat S.A., et al., 20-32299 (KLP) (Bankr. E.D. Va) retained by a creditor group and its indenture trustee regarding solvency analysis of Intelsat S.A., providing both deposition testimony and testimony at the bankruptcy confirmation hearing in connection with his expert report.
